Terms and Conditions
Article 1 – Definitions
1.1. Foundation: Stichting Club Dwars, having its registered office in Rotterdam, Chamber of Commerce no. 97423386.
1.2. User: any natural person or legal entity who visits the Website, takes part in activities or makes a donation.
1.3. Website: www.clubdwars.nl
1.4. Services: all activities, events and (online) services offered by the Foundation.
1.5. Donation: a gift by the User to the Foundation, without consideration.
Article 2 – Applicability
2.1. These terms and conditions apply to all offers, registrations and donations via the Website or otherwise with the Foundation.
2.2. Deviations from these terms and conditions are only valid if confirmed in writing by the Foundation.
Article 3 – Offer and Formation of Agreement
3.1. Registrations for events may be made via the Website or by e-mail.
3.2. The agreement is concluded as soon as the Foundation has confirmed the registration or donation by e-mail.
Article 4 – Participation in Activities
4.1. The User declares that they are in good health and will provide their own necessary equipment.
4.2. Cancellation by the User must be made in writing.
- Free of charge up to 14 days before the start;
- Thereafter, we reserve the right to charge (part of) the costs.
Article 5 – Donations
5.1. Definition and Purpose
A Donation is any voluntary gift without consideration.
Donations are used exclusively for the objectives set out in the statutes of Stichting Club Dwars.
5.2. Acceptance and Refusal
The Foundation reserves the right to refuse donations or—in consultation with the donor—to reallocate them if a gift conflicts with our mission or statutory objectives.
Donations take effect at the moment of receipt (upon credit to bank account IBAN NL78RABO0131486322).
5.3. Irrevocability
A donation once made is unconditional and cannot be withdrawn or reclaimed by the donor, unless otherwise required by law.
5.4. Tax Certificate
Requests for a receipt may be submitted via [email protected] within three months of the donation.
5.5. Confirmation and Transparency
After receipt, we will send an acknowledgment by e-mail within 14 days.
Each year we publish an overview of how donations have been spent in our annual report.
Article 6 – Prices and Payment
6.1. All prices for participation and donations are stated in euros, including VAT for paid services.
6.2. Payment must be made within 14 days of the invoice date, to IBAN NL78RABO0131486322 in the name of Stichting Club Dwars.
Article 7 – Liability
7.1. The Foundation is not liable for any damage, unless it is the result of intent or deliberate recklessness by the Foundation.
7.2. Liability is limited to the amount paid out under the relevant liability insurance, plus the deductible.
Article 8 – Intellectual Property
8.1. All intellectual property rights to the Website and the material offered rest with the Foundation or its licensors.
8.2. Nothing may be copied, distributed or published without prior written permission.
Article 9 – Privacy and Data Protection
9.1. For the processing of personal data, we refer to our Privacy Statement (www.clubdwars.nl/privacyverklaring).
9.2. By registering or making a donation, the User consents to the processing of his/her data as described therein.
Article 10 – Confidentiality
10.1. Parties are obliged to maintain confidentiality regarding all confidential information obtained from each other or from other sources in the context of the agreement.
Article 11 – Force Majeure
11.1. Force majeure shall mean any circumstance beyond our control that wholly or partially prevents performance of obligations or makes performance unreasonable to demand.
Article 12 – Amendments to the Terms and Conditions
12.1. The Foundation may amend these General Terms and Conditions. Amendments will be published on the Website and will take effect 30 days after publication.
Article 13 – Governing Law and Disputes
13.1. Dutch law shall apply to all legal relationships between the Foundation and the User.
13.2. Disputes will be submitted to the competent court in the Rotterdam district.
